Archival historyThe District Court (Scotland) Act 1975 (as amended) provided that each local authority in Scotland must have a District Court. District courts were the lowest form of court in Scotland and dealt only with summary matters and were lay courts where a Justice of the Peace who was not legally qualified sat with a legally qualified clerk. The most common types of offences to be dealt with in the District Court were breach of the peace, assault, vandalism, theft (but not theft by housebreaking), speeding, vehicle excise, T.V. licensing, electricity fraud and other miscellaneous road traffic offences.With the passing of the Criminal Proceedings etc. (Reform) (Scotland) Bill on 18 January 2007, the District Courts became Justice of the Peace Courts and their administration is undertaken by the Scottish Courts Service. The administration will transfer from the local councils during 2008-2012.
